Legal Question in Personal Injury in Texas

Libel

The above problem concerns an opinion or advice given to wife by her in email form. My wife and I are having marital problems and trying to talk or resolve this best way we can.

My question is do I have legal rights to claim libel against this friend (she is not a professional psychologist nor marriage counselor) of hers who maliciously wrote negatively about me without knowing the full extent of the problem. It was a biased and judgemental advice that had further complicated my relationship and my reputation.

She (friend of the wife) also lied to her via email. I do have copies of the email which she had sent.

If the statements are untrue, then they would be defamatory. If the "friend" has the money to compensate you for the expensive costs of litigation and pay for damages, you have "legal rights" which you can assert. The big problem in cases like this is - you have the right and you could probably recover, but, so often, these cases are to expensive to pursue for the potential recovery.
