Legal Question in Personal Injury in Texas

Long story short, I was shot in the eye close-range from a guy holding a paintball gun. He knew exactly what he was doing, I was not wearing any gear necessary for the sport and he still shot until he hit me twice in the stomach, once in the arm and once directly in the eye. I was rushed to the hospital and went on to see an eye doctor for months. I stopped seeing the eye doctors because they said I need surgery and I can't even afford to pay the eye-doctors, much less have surgery. He has given me a total of $200 and since then (a few months ago) he has not responded to any of my email messages. He is deployed in Iraq right now, he is a soldier. I want to know if I can sue him or if I have to wait. If I have to wait, can I go to his command that is still here in the states and get something done about this issue? I never turned him in for the incident because he said he would help us anyway he could.

when did it happen? did the shooter live in a home with family?i so,homeonwer's insurancecould cover the damage..call us or some local lawyer knoledgeable in personal injury/insurance
