Legal Question in Personal Injury in Texas

my name is marcus tavira i am 25 years old. i was incarcerated in t.d.c in texas. i was a trustee i was working in a community squad where we was building a baseball field .i was injured on the job where i broke my spine and ended up paralyzed. the officer failed to secure the bucket that was being lifted and the machine gave out and it fell on top of me..now im in a nursing home..my whole life has changed. so my question is .Can the state (t.d.c) be held accountable for my injury? can i sue the state for having us in a unsafe job site? and can the officer be held reponsible? i want to sue t.d.c. and do i have to take it to a supremne court to get a result? can i sue for pain and suffering? i was told that t.d.c has a cap, so is there anyway to get around the cap and sue for more than just the cap?
