Legal Question in Personal Injury in Texas

What can they do to me?

Over four years ago I was driving an unregistered car that we were going to buy and due to bad ice I hit a Redlight camera in a median and knocked it over. It didn't hit anyone and the only damage was to the Redlight camera box that fell. I filed with my insurance but we never herd anything from the red light people until 2 weeks before the statute of limitations was up. Then they finally filed. Now my insurance has denied the claim and the Redlight camera people want me to pay over $10,000. I really don't have $10,000 to pay them and I want to know what they can really do to me. They can take me to court but I don't own ANYTHING in my name that can be used as collateral so what am I looking at here. I don't know the law and would talk to an attorney but don't have money to pay them either. I don't know if this matters but I live in Texas. Any help or advice would be appreciated. Thanks so much.

We got the car from some guy who got it from an auction. We don't even have his information any more. And we don't have the vehicle that hit the camera anymore either.

They said they denied it because the original owner needed to file with their insurance but that was over 4 years ago so now there is nothing we can do. We had full coverage on "any" car we drove supposedly but they denied it anyways because they were unable to talk to the original owner. The title we got was from the auction that the guy got it from. It's a mess I know. We ended up buying it and had it for over 3 years but no longer have it.

Oh and I dont work either I'm a stay at home mom. My husband owns his own business so not sure what they can do there.

You can plead in your answer in the lawsuit that the accident was not the result of negligence but due to ice. If you did not know it was there and it was unexpected that might work. The defenses are act of God, sudden emergency, unavoidable accident. You need to put these in your answer otherwise they're waived. Object to any documents submitted as hearsay. That might keep out some of its evidence.

You have a community property interest in your husband's business.
