Legal Question in Personal Injury in Texas
What is a nurses liability for transporting the patient, family?
I am a home health nurse that has been asked by my patient's mother to transport him to and from Dr. visits.
I do have a consent form on file at the office for this.
Lately, the parent is wanting the nurses to transport her other child to and from school in our personal vehicles. She also wants us to taxi drive her around.
I feel very uncomfortable with this. My company is trying to come up with a written policy on the issue. I am wanting to know, for my own piece of mind, if I would be held liable if the child (not the patient) were to get into an accident and the child was seriously injured or even killed. I am wanting to find something written that explains this type of situation. I fear of one of us loosing our liscense if this was to occur.
Thank you

Re: What is a nurses liability for transporting the patient, family?
You are right to be concerned. The insurance on your personal vehicle may not cover using your personal vehicle to transport patients. If your company has no coverage for you, you could be facing personal liability if there was an accident. I recommend discussing this with your company as soon as possible.
