Legal Question in Personal Injury in Texas
My parked car was totaled by a drunk driver. I am still making payments on the car and owe about 9,000. I do not have GAP. Is her insurance only going to pay the Blue Book Value on my car? If so what about the remaining balance that is payed on the car? DO I have to continue paying for a car that I no longer have?

What you owe on the car and what the drunk driver's insurance company will pay for the car is two seperate things.
The drunk driver's insurance company evaluates the car from Kelly BB along with sources such as dealer quotes and want adds. It does not matter to the insurance company how much you owe on the note and you, not the insurance company, is responsible for paying on the note.
