Legal Question in Personal Injury in Texas

I was a passenger in an accident in which the driver was at fault and I was injured. Not only has the attorney I tried to use dropped my case, but they said that in order for me to get paid for my injuries the driver of the car I was a passenger in has to sign a waiver. Is this true?

I'm not sure what they are talking about. I would have to review your case files. In most instances, you can go after the driver's insurance, if you are injured as a passenger.

A policy holder can reject uninsured and PIP coverage. Perhaps the driver rejected (waived) this coverage? But, you say your driver was at fault; so liability coverage should apply. The driver has a duty to cooperate with his insurance company. If he doesn't, then the insurance company can use that as a basis for denying coverage. Maybe that is what is happening?

You should hire another attorney. If we cannot recover your damages, we ought to be able to explain to you why not.

Let me know if I can help.
