Legal Question in Personal Injury in Texas

I was a passenger in a semi truck that rolled and I was injured with soft tissue damage anxiety depression etc My life has been completely ruined because of this.The driver claims the wind caused the rollover but in fact it was the driver had fallen asleep in the accident report it says extreme cross winds caused truck to hit a elevated embankment and driver performed faulty evasive maneuver by not steering back on to roadway its clear as day the driver fell asleep there's no markings or indications driver even attempted to steer truck back onto road it clearly shows it just veers off the road and rolls not to mention I'm sure there's videos of all the truck stops rest areas we stopped at and when did he sleep?let me add I have a text message from his boss saying to the driver to fix his log books before meeting with insurance company.So why is it the insurance company calling this an" act of god"?Also why didnt the state trooper do a field sobriety check or look at the drivers log books.please help I live in California and the accident happened in Texas I had attorney over here in CA but since the insurance company only wanting to offer $10,000 and my medical bills are this amount my attorney did not accept and since it needs further action the attorneys cannot represent me since the accident was in TX I should be receiving my file soon and everything's been done litigation etc please help me for I'm already going thru enough with this nightmare.
