Legal Question in Personal Injury in Texas

What to do if the person causing the injury accident got killed.

What does anyone do if the person that caused an injury accident got killed in the wreck? The person did not have any car insurance and did not have a driver's license either. Whom do we sue or take to court to settle all the out of pocket money that we have acquired so far in this matter? We did not have any uninsured motorist insurance, just the legal amount of insurance for the State of Texas which is liablility only. Any suggestions as to what to do or where to go next? No inury attorney would take our case because of the circumstances with the party that caused the wreck not having any insurance or a driver's license. Is'nt that nice. Why do people like the person who did cause the wreck or their family get off ''scott free'' in the matter because she died? Need some answers please? Thanks so much. C.

You may be able to fish out coverage if the deceased didn't own the car s/he was driving. Otherwise, you would have to go after the deceased's estate (assuming the deceased had assets.)
