Legal Question in Personal Injury in Texas
personal injury while a patient at a hospital
while a patient in a hospital detox facility for alcohol, i received a self inflicted injury to my wrist. I was on medication, and barely remember the incident. If standard procedures employees are supposed to follow(according to literature passed out to all new patients), I would not have had accesses to the broken glass. Also, although i didnt remember until recentley, I had apparently asked several employees of the hospital to talk with me because i was upset, and i was told they didnt have time to deal with me. shortly after that, the incident happened. I now have over two years sober, and bits and pieces of my memory are starting to come back. I need to know what the statute of limitations is, and if it applies to my case.

Re: personal injury while a patient at a hospital
It appears that you are out of luck. The two-year statute of limitations runs from the time of the conduct complained of, which in the instance I assume is more two years after you cut yourself.
Even if you did not have a statute of limitations problem, there is a great concern about whether the damages are sufficient to justify a health liability claim. Because you did not die, there is no wrongful death claim. In my opinion the expense of preparing the case for trial might exceed your expected recovery.
