Legal Question in Personal Injury in Texas

My daughter went to have her hair bleached 1/04/08. Appt. was for bleach only. The stylist took 6.25 hours-should have been 3.5 hours and he, along with the manager, performed a service not asked for which also resulted in my daughter's scalp being burned. There were blisters and the scalp got infected. She is still having trouble with feeling in the scalp. I contacted the main office in Illinois for this salon & they did get the TX shop to refund the money-the shop put ''allergies'' as the cause of injury on the receipt which I kept. Was told to submit med. bills to store, then had to contact the insurance company. The ins. rep was rude/uncooperative & said nothing would be paid for pain even tho' the rep said the stylist admitted my daughter was in pain when he applied a chemical treatment that was never asked for. Can my daughter collect for pain and suffering? Plus, at one pt. the stylist wiped bleach from the back of his hand onto my daughter's forehead. Without going into more detail, my daughter and I both believe the stylist & manager did this intentionally, they knew/should what the chemicals would do, plus some of the statements made by them led us to this conclusion. Her hair, as would be expected, is damaged.

Pain & suffering are elements of personal injury damages. Certainly, your daughter has/is suffering from pain. There are probably more damages. Why don't you go to a lawyer. Obviously, the insurance adjuster is not going to pay you anything. That's their job. Good Luck
