Legal Question in Personal Injury in Texas

my personal and private issues exploited at my work place.

I just had an auto accident in the mall parking lot where I work. The lady and I exchange info and went to call the cops. When I returned she was gone. Supposedly she had a witness who saw the accident, and it fit her version of what happeded. They are trying to make me liable for damages. What do i do? In the mean time, this lady has went to my work place and spoke very negatively about me, saying that I'm crooked and into insurance fraud. She also told people not to shop at my store because of it. She stated the she called the cops on me, when in fact it was I who called them to the scene. For her to go to my work place and talk falsely of my personal issues is disrespectful and embarrasing. I want to file suit against this lady for that. How do I go about doing so?

Oral untruths are slander. You would have to show damages for the "disrespectful and embarassing" remarks, i.e. what did it cost you in money. Unfortunately, juries do not award much money for disrespect and embarrassment.

Depending on whether or not you could prove damages to you and your business by her remarks, you could sue her for slander. But, you would need to prove actual damages.
