Legal Question in Personal Injury in Texas
PI Deposition
In 03/98, I was involved in a head-on collision with an 18-wheel tractor trailer while I was an out of town passenger on a business trip. I subsequently sustained neck and back injuries for which I continue to receive treatment. I currently live in California and have been summoned to Dallas, Texas for the purpose of a formal deposition. Must I attend the deposition in person or can the proceedings occur via telephone/video conference? If I am required to travel to Dallas using a professional vacation day, who is responsible for the related expenses associated with air fare, lodging, meals, local transportation, etc.?

It seems that the lawsuit has been filed in Texas and I am unfamiliar with the laws of that state. However, since you live in California they may have to abide by the laws of this state. The California code states that a deposition must be taken with 180 miles of the deponents residents. Obviously, Texas is not within 180 miles of your residence. Now have you filed a claim for the injuries you sustained? Who filed this lawsuit and who is taking your deposition? Do you have an attorney?
