The claim would be filed against the driver of your car or the insurance on the car you were riding in.
As a passenger, you should not be liable for the accident.

No, you are not handling this properly. It appears as though everyone else has filed a claim and gotten their side of the story out there but you. You are a passenger, and therefore can't be negligent. If you're injured, you should contact a doctor and a lawyer to make sure you have everything under control. My office is closed for the weekend, but I'm available via email if you wish to discuss this further.
Without more information, it's hard for me to say whether or not you are handling this matter properly. Sometimes other drivers file claims even though they were completely responsible for causing the accident. If your driver was partially at fault or arguably partially at fault, then you might be able to recover from his insurance company. Depending on your relationship with the driver, his culpability, and your damages, you may or may not want to make a claim.
