Legal Question in Personal Injury in Texas

Property Insurance Claim

My husband recently broke his arm in the park where we live. It was very dark in the area and we have noticed there are no street lights working. They are there, and did work when we moved in, but are still inoperable as of today. Could we possibly have a claim against the property owner's insurance? The injury was pretty severe and required surgery, an implant and will require months of therapy. When he spoke to the property manager about falling because it was dark, she stated she had called TXU to get the lights repaired, but they would not come out on her authority and the property owner had to call. It has been rumored that TXU has been out recently and cannot get the lights to work. There is currently a red ''problem'' light on the main transformer. I have dated pictures of all of this. Please advise of our rights and if we do or do not have cause for a claim. Thank you.

You did not say whether the "park" was a public park or private land. Completely different rules apply to governmental entities.
