Question about what I should expect from my lawyer
Is it typical for a lawyer who is to be paid 33% of any settlement to expect the client to do all the legwork?? I have a lawyer handling 2 seperate car wreck cases. On both accidents the lawyer has refused to do any legwork. I have signed release forms so that the medical facilities can release my information to my attorney but when he wants a bill or can not find a bill that has been given to him, he expects me or my husband to take time off from work and do to the places to gather the bills and then go to Kinko's and make copies and then make the more than an hour drive out to his office to deliver the copies. It seems unfair to me and I wanted to know if this is normal procedure.

Once a medical provider learns an attorney is involved, it will often charge or charge more to provide copies. At times, I've been told that the client can get a copy at no charge, but if I ask for it, then I have to pay a fee. The attorney then passes these costs along to the client when the case settles. Sometimes, I will ask a client whether they want to help get the bills for free, or have me order and pay for them. Some clients would rather have more $ with a little effort, then have me make such expenditures on their behalf.
Clients should keep copies of bills that are mailed to them and furnish their attorney with a copy, but often they lose or misplace them and never send them to the attorney. This can create unnecessary work for the attorney.
I'm not sure about the precise reason why your attorney asked you to get the bills. You probably ought to ask why. I wouldn't drive an hour to make deliveries when you can mail them for a fraction of the cost.

without seeing your contract, and I presume you have one, no that is not normal. But call and speak to the lawyer, ask him to put it in writing..and you may have a basis to change lawyers..but most lawyers will not take a case when one lawyer has an interest for work done..

I try to never criticize another lawyer without hearing his side to the story. All I'll say is this: In my firm, when you hire one of our attorneys, we feel you have the right to expect us to do the "leg-work" for you. Obtaining medical records and bills is just one part of what you've hired us to do. While the attorney certainly needs the cooperation of the client and may occasionally call upon the client to supply certain information, asking the client to pick up documents and deliver them to the attorney's office is not something we believe the client should be asked to do.
