Legal Question in Personal Injury in Texas

Hi quick question,

My husband wrecked his Z06 on Aug 24, 2010. He immediately drove the vehicle to the collision repair shop and I was there to take him home. It has since been several months and the car is still not completed. The owner of the collision repair shop indicated that his "tear down guy", the one who took the vehicle apart quit last month and he had to take another repairman off a job and put on the Z06. There have been several due dates come and go and now it looks as though we're 60-70% complete but not real progress has been made on completing the vehicle in the past few weeks. What should be our next step? We are concerned about the amount of time, the insurance company and the car being completed and intact. Please advise.

Did he choose the repair shop? Was it a collision with another vehicle? It's hard to answer this without all the facts. You generally have 2 years to bring an action against someone for their negligence in causing an a collision and causing damages. Just keep working with the repair shop. If it gets worse, you can always remove it and take it to another shop. You would have to put the money up front if you do that most likely. The insurance company should be covering a rental in the meantime if it was because of the negligence of another driver. I just don't know enough information to give you a more definitive answer.

In my opinion, you will probably need court action..and if the shop is small, they may not have the money to pay for your loss of use. Call me if you wish to discuss as there is not enough info to really advise..who makes the decision, you or your husband?
