Legal Question in Personal Injury in Texas

rear-end automobile collision

I was rearended by a commercial vehicle and takent to the emergency room and released with minor muscular injury. The police did not issue me a ticket. That particular driver and his company have so far refused to claim any responsibilities. Without having read the police report, what are my chances of getting any compensation if I elected to sue the driver/his company. (As of now, neither parties have read the police report.) I do not know if the police had issued the other driver a ticket. He tured into my lane, and have probably miscalculated vehicular distances when he struck me from the rear. ( The police did inform me of tiretracks that was created by the commercial vehicle, and that is all that I know.)
