Legal Question in Personal Injury in Texas
Received letter for debt collection from Gieco. I was without insurance and hit a car. What are my options?
Hi, In the month of Oct my insurance expired and I was not informed about that by the insurance company- Geico. We had a new baby in Oct so were really busy and never thought of insurance. However it should have been my insurance company to inform me of this. 10 day after expiration I met with an accident and when I called my insurance they told me I am uninsured. I asked them to renew my insurance straight away, how in the world can they allow me to drive without insurance. The renewal happened 1 hour later to the accident time, the same day. Next day I was informed that I was not covered while accident so my insurance will not pay for the accident( other guy is with the same insurance provide). Now 4 months later I have received a debt collection letter from a Asset mgmt company on behalf of Gieco, and they want me to pat $4,600 for that minor accident. Am I liable to pay this? What options do I have? Is filing dispute worth it? How do we file a dispute?

Under TX law you have a duty to make sure that your car is covered with a liability insurance policy. So, you are responsible for the other vehicle's damage if your caused the accident. If the other driver's negligence contributed to the accident, then your responsibility for paying would be so reduced. If you can, argue the other driver was proportionately responsible.
I think you will have a hard time complaining about GEICO's actions.
You can also offer to pay only a portion of the $4600.
