Legal Question in Personal Injury in Texas

should i seek a lawyer

Both my son and I were rear ended on 5/15/04. We both went to the doctor a week later and we were both diagnosed with back pains. I was referenced to a chiropractor but I have not been because I was told my health insurance would not cover it. The defendants insurance company is requesting that I release my medical history. How should I proceed, is this something that I can handle on my own for negotiation purposes or is it worth needing a lawyer? It was a minor accident with minor injuries and car repairs. I have spoken with a lawyer, and they are sending me to a chiropractor which will accept a letter of protection. My son is too young and can not undergo chiropractor care. Is it really worth it? If I do it on my own it may take some additional time before I can seek the proper treatment I may need. However, I may be able to survive without it. Please help.

In such a matter it is good to have an attorney look over what the defense attorney is asking you to sign. Think of it this way, they work for the other side. You should speak with an attorney or two and have them review the accident report, if any.

With regard to the injury, you need to let a doctor determine the severity. Not only will a chiro accept a letter of protection, but so will most other physicians.

It sounds like you have retained an attorney. Have you? If not, I would recommend you doing so. There are many fine ones in your area. Also, since you son is young you should have his see a physician to make sure there will not be any problems later on.
