Legal Question in Personal Injury in Texas

Shafted by an insurance company...Liberty Mutual

I was hit from behind in my automobile. My brother ran into the back of my car, while I was yeilding right of way. His insurance company is Liberty Mutual. The accident happened on June 15. 2003. I had a used car that cost me $1000.00. My brother had a brand new jeep. His car was damaged in the front and my car was totalled, with the trunk being almost pushed into the back seat. Liberty Mutual paid me $500.00 to replace my damaged car. They immediately whisked the wreck away and told me that I was under investigation. They stated that the adjuster said that the area of the damages did not line or add up. Liberty Mutual indicated to me that they were going to hire and expert to recreate the accident. I told them that I had been hurt in the accident. They advised me that if I were to get a lawyer that he would just take away half of what they (Liberty Mutual) were going to give me anyway. I decided to not get a lawyer and wrote a complaint to the Insurance Commission in Austin. Anyway, they have done all they can to not pay any damages, by dropping my case whenever it suited them. I contacted them just prior to the end of the statute of limitations in May 2005, and was given information that my case had been transfer.

You should have hired a lawyer within the statute of limitations. Now, there is practically no possibility of recovery.

This is just one more example of an insurance company lying in order to avoid paying. (Please see our article on "worst insurance companies" at www.srfirm.com.) Unfortunately, if you have missed the statute of limitations without settling your claim or filing suit, your claim is barred. Please, please contact a lawyer promptly if you ever have another accident. Any good personal injury lawyer can get you more money, even after deducting his fee, than you could have gotten for yourself.
