Legal Question in Personal Injury in Texas

Ski accident

My husband was skiing with friends. One lost control and crashed into him resulting in my husband having broken ribs as well as a punctured lung. We have a $2,500 deducible as well as an 80/20 split for health insurance. Would the friends insurance of any kind assist us in paying for this as it was caused by his loss of control? Or are we just out the money? We don't care to sue him as this is a good friend, but I'm thinking some sort of his insurance could cover our out of pocket. Any ideas?

Your friend should ask his insurance agent whether any of his insurance applies. If not, you should tell him about how much his mistake has cost you and see what unfolds.

Unless he was taking outrageous chances, I doubt the insurance policy covers "loss of control". It's part of the risk of the sport. Good Luck.

Ski law is state law, so whether there is a viable claim depends upon where the ski accident occurred. Typically if the accident occurs in a state such as Colorado there may be a claim depending upon the facts of the accident, and if the negligent skier has homeowners' insurance, there is insurance coverage for a personal injury claim.
