Legal Question in Personal Injury in Texas
Slip & Fall at Walmart
The other day I slipped on a shampoo like substance that was on the floor. There were no yellow floor signs or anything to indicate that there was something on the floor. I filed an accident report with the store and then went to the ER because my knee was hurting. I ended up with a torn meniscus that requires surgery. I've missed work this week and I don't know what to do. I'm not a big fan of lawsuits but I'm starting to think it's a good idea. I know I have a case but it would be very hard to prove. Does anyone know of any good defenses in a slip & fall case?? When should I consult an attorney?

Slip and fall cases are usually difficult to win. Your question did not include enough information to give you advice on your particular case. That said, I recommend you seek the advice of a personal injury attorney as soon as possible. Wal-Mart has an insurance carrier with professional adjusters and attorneys on their side to either limit or deny your claim. Unless you have someone knowledgeable on your side to assist you, you will be at a severe disadvantage.

There are defenses to a slip and fall case, but I would need to know additional facts before I could discuss them with you intelligently. As for when to get a lawyer, typically, sooner is better. Your attorney can work with your health care provider to ensure your medical bills are taken out of any recovery you receive. Let me know if you need more help.
