Legal Question in Personal Injury in Texas
Sold a my truck 3 years ago and now being sued
I sold my vehicle 3 years ago while in the middle of a big move. One year later the person I sold it to was involved in a accident. The other individual involved never contacted their insurance or asked for any medical attention at the time. A week ago, I was served papers that I was being sued in a civil case by the person that was in the accident. I know I sent papers to the Department of Motor Vehicles to get the title changed but they never did it, nor did the person I sold the truck too, change the title either. I was served on the last possible day before the statue of limitations ran out. I have a proof of sales and the police report shows the kid as the owner of the truck at the time of the accident and he was carrying insurance on the truck.
I am being sued for personal injury, pain and suffering, and they are claiming the person driving the truck was a employee of mine which is completely false. She still hasn't contacted her insurance about the accident 2 years ago. What should I do

You should contact the insurance company you had while you owned the truck - immediately. Make sure they file an answer on your behalf. Even if they back out later, at least get an answer on file.

You need to notify the insurance company you had at the time you sold the vehicle. You need to file an answer to the lawsuit. This could be done by your insurance company or by your own personal attorney. If an answer is not filed, you risk the possibility of a default judgment.
