Legal Question in Personal Injury in Texas

Our son was a passenger in a vehicle that crashed,and he was killed. the driver was "impaired",but not over legal limit for state of virginia. the computer in car said he was doing 96 mph (in the rain at night) when the vehicle left the road and hit a tree,and landed in a water-filled ditch. my son was 18 yrs old . the driver was 19 at the time . back seat passenger was 21. they were all active duty military. what recourse do we have? and who do we have recourse with? we live in texas. accident happened in chesapeake,virginia
