Legal Question in Personal Injury in Texas

Stiff neck

I was involved in an accident 9/05, didn't seek medical attention, because I felt ok.

The following month I blacked out and was hospitalized. I started to have some problems throughout the following months, not sure if one was related to the other. A year later I think the fall was related to the initial accident due to a mri xray showing herniated discs.

I did talk to the insurance company, but during my interview I revealed to much information. I told them I slipped off the commode. What actually happened, when I was getting up, I think I blacked out, cause when I awaken I was on the floor.

They tell me I have no claim because of that incident.

I think the accident caused the disc herniation which put pressure on my spinal cord, which cause the black out.

Is this a lost cause?

How long after an accident can you try to claim injury?

I appreciate any information.

Thanks, Stiff neck

Re: Stiff neck

What do your doctors say? Your testimony corrobarated by your doctors that his injury was caused by the accident could support a claim for damages. Did you have similar problems before the accident? We have had success when liability is clear and medical testimony supports your claim...but how could one know of the severity of the injury until one blacked out..and of course, rarely trust insurance adjusters ..

You are pretty much out of luck because you didn't immediately seek medical attention. Sorry..!
