Legal Question in Personal Injury in Texas

I was subpoenaed to be a witness in municipal court for an individual who received a traffic ticket for an accident I was involved. I did not show up the first time but was subpoenaed again. I will be a hostile witness and my question is how can I legally refuse to be a witness in this case? Can I be penalized if I don't show up again?

You have a legal duty to appear when summoned. If you refuse to appear, the judge could find you in contempt of court. Tell the attorney who subpoenaed you how you will testify. If it's adverse to his client's interest, then he won't want you to appear and can release you from the subpoena.

If you show up in court the defendant who hit you will get your testimony for nothing. If you don't his ticket will be dismissed. Call me if I can help.
