Texas Tort Claims Act

One of Houston Metro's traffic signals fell on my car and damaged the hood. Now they are telling me that they are not liable for fixing my car because they did not know the light was broken beforehand. Therefore under the Texas Tort Claims Act they are not liable. Is this true?

It may or may not be true. You could argue they failed to properly maintain the sign and it would not have fallen in the absence of negligence, but they will likely make you sue them.
