Texas Tort: Student injured in chemical release

High school had a chemical leak in the

indoor pool area causing student injury

including facial irritation and

pneumonia. Student is trying to

recover ambulance and hospital

charges. Are these recoverable in Tx?

Public schools are generally immune from liability for personal injury claims unless the injury was caused by a motor vehicle. Nonetheless, you can always submit the medical bills to the school and see if it will voluntarily compensate you. If the student attended a private school, then the damages may be recoverable.

If a 3rd party was involved, e.g., a pool maintenance company, then you might be able to make a claim against the 3rd party.

Unfortunately, all public schools in Texas are totally immune from personal injury claims unless a motor vehicle is the cause. This also includes public universities. If a private company were in charge of maintenance, however, you might be able to sue that company.
