Legal Question in Personal Injury in Texas

Tire Problems

We purchased new tires & had them installed by a major corporation. On a trip a week or two later, the LF tire appeared to be out of balance and getting hot. We limped into the local store of the chain that had sold us the tires. They removed the tire and out fell the tire sensor and foreign material apparently someone had used to hold it in place. Employees in the tire shop were embarrased and apologetic at what they discovered in our tire. The tire was remounted without the sensor & we continued our trip. One employee signed our invoice and told us he would be glad to talk to whoever we needed to verify the incident. Upon return from our trip we took the vehicle to our auto dealer. They replaced the broken sensor and removed the other tires to check for problems. Both rear tires also had broken sensor bands that had been patched with material that shouldn't have been inside tires.

We are working with the district Mgr. of the corp. that installed the tires and plan on filing a claim for damages. Fortunately no one was injured but we think the company should be accountable for some type of real or punitive damages. Any suggestions on a damage amount that might be appropriate without taking the claim to court?

Nothing...you would have an expensive Court case to prove the company knew of the problem. Unfortunately, only when there are serious injuries is it economical to file a lawsuit.
