Legal Question in Personal Injury in Texas

Type your question here...I was hit by a person running a stop sign totaling my van and slightly injuring myself and my 3 kids. We were all taken to the ER and have seen drs since. I can't afford my physical therapy. My van needs to be replaced. I need a rental. My daughter lost work hours. My kids have medicaid. This happened in Rosenberg, TX

Should I handle this with her ins co or get an attorney? I just had liability ins.

The answer to your question is, no, you should not "handle this with her insurance company" rather than "get an attorney." Insurance companies make billions in profits, not by paying claims, but by figuring out ways to not pay claims. When you attempt to handle a case like this on your own, you are in way over your head. The insurance company has teams of lawyers representing them; why shouldn't you have an attorney representing you (and, especially since you have children who were hurt)? And not just any attorney will do. Even though every attorney licensed in Texas is legally allowed to handle personal injury claims (just as any doctor with a license can perform brain surgery), that does not mean that you should let them. Retain an attorney with at least 10 years experience (the attorneys in our firm average over 25 years experience handling nothing but accident cases) and preferably one who has handled many, many motor vehicle accident cases (we have handled over 8,000). And, whatever you do, retain an attorney NOW. Please don't wait until you have attempted to settle the case on your own and have given the insurance company all the information they need to deny or diminish your claim.

Do not handle this yourself.

The insurance company is NOT your friend but your enemy. Their only goal is to frustrate you and pay you little $ so you can away.

Do not sign any insurance company documents, give a statement to the insurance company, or give them access to your medical records or Medicaid information.

You need to contact a Dallas personal injury attorney. You will need help with your car, your injuries, and dealing with Medicaid.
