Legal Question in Personal Injury in Texas

I was a unauthorized injured passanger in a big rig that rolled driver told state trooper the wind was the cause but truth is he fell asleep in the accident report it states high cross winds caused tractor and trailer to veer north then hit a elevated embankment causing tractor trailer to roll 1/4 time it also says driver r performed faulty evasive action by not steering back on the roadway it clearly shows truck veering off caddy corner like and no tire marks etc to show driver trying to control truck/fight the wind unfortunately it's been 15 months since the accident and to subpoena video of all the truck stops we stopped at to prove when did he have time to sleep. My story is i hired a Ca attorney to represent me but when the attorney submitted a demand insurance Co offer was $10,000 &that;'s what my medical bills are alone beings the insurance Co new that a Ca attorney could not represent me because accident happened in Texas the attorney decided to drop my case told me I owed them nothing said everything was done for the new attorney and advised me to get a Texas attorney immediatley I have a back injury depression etc a letter from a orthopedic surgeon stating my injuries are more likely than not to have been caused by this accident he also goes in to say i may need surgery in the future so my question is typically what is likely the settle amount on something like this because I consolidated with a Texas attorney and was told they could probably get in my pocket $12,000 this does not sit well with me because my previous attorney told me he was going after commercial limits?please someone help me put my mind to ease I've gone thru such a dramatic life style change from a healthy independent energetic full of life lady to a depressed over weight in pain dependent with no life I can't even leave my house at times

You should definitely speak to more than one injury lawyer. It sounds like they are not compensating for your future medical care, which is something that you can recover under Texas law.

Run, do not walk to the lawyer's office that you trust and who is competent. Tell him all of the facts, the good and bad and the ugly. Forget your unfortunate experience with your CA. Lawyer. Just make sure your lawyer is someone you trust and who is competent. If you need medical care, get it immediately and keep getting it and going for treatment as long as you need it. If you do not need treatment, do not go to the doctor.
