Legal Question in Personal Injury in Texas
Unfairly compensated.
While stopped at an intersection a dump truck hit my wife from behind. He hit her at about 30 mph and was arrested at the scene for having no driver's license. Our car was nearly new, with only 8,000 miles on it, but was a total loss. The truck owner's insurance company truck is paying the market value of the car, not enough to pay what is still owed on it. Isn't there some way that we can recover at least enough money to pay off the car and get us into another one? How is it that we were completely innocent and yet can end up $4,000 in the hole? There has to be some recourse.

Without a doubt, you are entitled to being put back in the same condition you were in prior to the accident. You need a good competent lawyer to help you. Insurance companies will rarely treat you fairly unless you have legal representation.

Most likely, you are entitled to being put back in the same condition you were in prior to the accident. That means you should NOT lose any money because of the accident. You need a good competent lawyer to help you. Insurance companies will rarely treat you fairly unless you have legal representation.
