Legal Question in Personal Injury in Texas
Are there ways around the statutes of limitaions?
I was injured in an work related accident in 1991 it involved an unlicensed operator on a lull lift, i was dead on scene, my face hit 1/4'' steel angle iron, lots of facial damage and of course much more damage. I had just turned 18 and i was very traumatized and in much pain so i lived with my parents and they helped me and took care of paper work and details. My dental work was never completed, i showed up for an appointment one day and was told i was not covered by the insurance. The insurance company claimed there ''was no file'' on me even though they spent around $25,000 on workmans comp, and very little of the hospital and dental bills.I had perfect teeth, not one cavitiy before the accident.I have delt with so much pain and now just this month the part of incomplete dental work fell out and i am fearing infection.I have wrote a letter to the insurance Company asking for there help with getting my teeth fixed, simply pull out the unfinished work and the few teeth left, put in dentures, simple and cheap.I also asked for a copy of my file.I understand a little about statutes of limitaions but surely there is something i can do if they dont agree to help. Im not asking for much im not trying to get rich, i just want what i deserve.

Genrally no. There are some limited exceptions for example if the victim of a car accident or other act of negligence is a minor or otherwise incompetent at the time of occurrence, then the statute of limitations starts to run after the child reaches his majority or the incompetent becomes competent. Good luck.
