Legal Question in Personal Injury in Texas

My wife was in an auto accident. The other party was found at fault, and has issued a check for her vehicle to be repaired. She has medical bills that were as the result of the accident, ncluding an ambulance ride and ER visit. If she cashes the check for the car repair, will it interfere with negotiations for medical costs?

Typically, the property damage claims are independent of the bodily injury claims. You should carefully read your documents to be sure. Also, do NOT do a case involving an ER visit with subsequent treatment yourself. I suggest you at least speak with a lawyer (most injury attorneys, myself included, will discuss a case like this with you for free.) In order to do the case properly (and not shortchange your wife) you should have professional help on it. The attorneys only get paid a percentage of what they recover for you, so it's in an attorney's best interest to maximize the value of the claim. The insurance company, however, will try to pay as little as possible. Feel free to call or email me if you would like to discuss this further.
