Legal Question in Personal Injury in Texas
My wife was in a car accident where some guy back into her car. No one was hurt but since we were going to trade-in the car for a new one the dealer is not willing to give the same value for the trade-in even when the car is repaired.
Do we have a re-course.

You are entitled to the market value loss of your vehicle. For example, if your car had a value of $6,000 before the accident and the repairs were $4,000 and after repairs your vehicle was only worth $5,500, then you could claim total damages of $4,500. Get the dealer to provide you with documentation so that you can show it to the insurance adjuster for the driver who damaged your vehicle and ask for diminution in value in addition to the cost of repairs.
