My two year old grandchild suffered Nursemaid elbow at her day care. The injury she sustained does not match the incident report we recieved from the daycare

As a plaintiff, you have the burden to prove that negligence proximately caused injury to the child. Without evidence of how the child was injured, you cannot meet your burden of proof. You may have trouble finding an attorney to take it on a contingency without such evidence.
Some businesses have insurance that pay medical bills regardless of fault. You can ask the day care facility for its insurance information to see whether it has such a policy.
