Legal Question in Product Liability in Texas
I had my 2005 Dodge 3500 transmission overhauled for $2300. several weeks later and 1600 miles away it burned up. later upon inspection a transmission specialist found that they had not put in a required seal causing it to loose fluid. Is the person that overhauled the transmission liable for damages?. I had to pay the second repair place $2400. Can I collect the $4700 I paid.?
Is a notarized statement of the finding by the mechanic admissible as evidence in small claims court?

Based on what you have written, you should review all the written documents regarding the first transmission overhaul to see if there are any limits on recovery. Then you should consider filing an action against the first shop/individual. You may want to consider speaking with a local law firm to ensure that you handle the suit in accordance with the Rules and to have the ability to potentially collect. If my local law firm can assist you with this legal issue or and other legal matter, please contact us at [email protected] to arrange for an initial consultation.
