Legal Question in Product Liability in Texas

Golf Cart Damage

Whilst golfing on a new course I had an accident. As I went over a hill on the cart path, there was a sharp corner. I did not slow down sufficient to take the corner, and rolled the cart on its side. My passenger and myself fell out, and damaged the cart. I cut my head, my passenger was bruised.

The golf course wants to charge a repair fee for parts of $600. On my credit card reciept for the green fees it says I am liable for the damage.

Is there any agruement I can make in that I am not liable for the fees, since the path was not adequately sign posted?

Re: Golf Cart Damage

you could make that argument as a part of any negotiation or if the course owners file a lawsuit to collect the 600. your defense is that the course's negligence was entirely or partially responsible for the incident and the damage to the cart. i would make sure that the course does not try to bill your credit card for the damage. if they do you should contest that charge. hope this helps. bill featherston
