Legal Question in Product Liability in Texas

property stolen by valet

I parked overnight at a hotel who contracted a valet company to do their valet services. The next morning, my $400 ipod which was attached to my stereo in my glovebox was missing. My girlfriend and I expressly remember putting the ipod in the glovebox and there was no sign of forced entry in the morning. We even know the initials of the man who parked my car. It is blantantly obvious that the valet stole the ipod. Do I have a case to be compensated by the valet company?

The problem would be proving the case (and the valet who stole it knows this--that's why this kind of thing happens all the time.). Additionally, your valet ticket (or a sign posted somewhere on the property) states clearly that they are not responsible for thefts. Any reputable valet service, however, would at least look into it, question their employees, and make an effort to recover your MP3. If that doesn't produce any results, you could file suit in JP Court, but, again, proving your case would be difficult. Good luck.
