Legal Question in Real Estate Law in Texas

I have about 17 acres in Texas which is currently financed through the Texas Land Board. I do not have the clear title yet as I am still paying the note. An oil/gas company came on my private property & set stakes for a drilling rig when I was not home. These markers for the rig are almost right behind my house. (The house is on a separete acre connecting to this land and financed through a different company.) I am a single mom with a 3 year old daughter & a 12 year old daughter living down a private dirt road in the country. What rights do I have as a "surface owner"? I realize they will drill regardless, but am very concerned about my children and also my horses that are on the property. My house also has a water well and septic. With the drilling so close to my house, I'm concerned it will do more damage to the already damaged foundation, ruin my water well that is on it's last leg, and ruin my septic system as well.

This is a tough issue. Unfortunately the oil company probably has the right to drill, otherwise they wouldn't spend the money to do so. You should talk to an oil & gas lawyer.
