Legal Question in Real Estate Law in Texas

In 2007 my wife attempted to do a lease to own from a home owner. She put down $5000.00 and was told the home would be ready to move in on a specified date. The home was not ready, and through back and forward of unfulfilled promised on the move in date, she told the home owner she no longer wanted to pursue the contract since he initially broke so many agreements of the contract. The home owner kept her $5000.00 deposit, I would like to know is that $5000.00 still be collectible, thank you.
