Legal Question in Real Estate Law in Texas
Over 10 years ago I sold some property in a subdivision that requires membership dues to be paid. I sold the property free of all liens and all property taxes and membership dues were current. I am now receiving letters from the property association and collection agencies stating that I owe several thousand dollars in membership fees. I contacted the property association and informed them that I sold the property over 10 years ago and mailed them a copy of the Bill of Sale and Warranty Deed. The secretary at the property association informed me that she remembered me selling the property, but the lady that I sold the property to never filed the deed with the courthouse. The secretary said that she tried to contact the lady that I sold the property to but she could not be located. So, the secretary informed me that the property still belongs to me since the lady never filed the Warranty Deed. What do I need to do to clear my name of this debt that I do not owe? Whether the deed was recorded or not, you did not own it from the closing of the sale and you don't owe the fees from that date on. If they keep bugging you, you can hire me to send them a letter setting out the facts.
