Legal Question in Real Estate Law in Texas

Abstract Judgment

Was in process of getting a Home

Equity loan. Bank informed us that

there are 3 abstract judgments against my husband, but they are not him. 2 have different address's.

Our home is homesteaded and is exempt but we were told that these judgments were on our property. Ive contacted each company who's name appeared on the Judgment but they are as confused as I am. How can I get this mess cleared up. Wm Johnson is a very common name!. HELP PLEASE.

Re: Abstract Judgment

You have a a few options, depending on the title company. In some cases, an affidavit of identity will do the trick. In other cases, you need a sworn document from each of the purported creditors. You should also pull your husband's credit report, to make sure there are no false issues there as well.
