Legal Question in Real Estate Law in Texas
Advertising as ''consultants''
I own Central Tejas Research & Title Services. We are asked advice by Spanish speaking buyers and/or sellers. We always say we are not attorneys, but we do have more than 20 years in title research as our background and do guide them through sometimes difficult land issues. We would like to advertise in the local Mexican Newspapers. Can we advertise as ''Consultants'' without being attorneys?

Re: Advertising as ''consultants''
Unfortunately if you are "advising" clients as to their rights and remedies concerning their properties, you are providing legal advice and Texas Statute provides that the Unauthorized Practice of Law is a crime. For example, "immigration" shops have been targeted by the state because of the vulnerable clientele who have been victims of bad advice or fraud. With that said, if you provide title reports that merely report the chains of title or status of title, you would be within the scope of services you are authorized to provide. For more information on the Unauthorized Practice of Law, go to www.texasbar.com.
Also, as a former President of a title company, I am very familiar with the authorized scope of services you can give. If you would like to email specifics on the services you seek to provide and I can respond to your direct issues.
