Legal Question in Real Estate Law in Texas

a bad move by my brother

My brother and sister-in-law divorced after 25 years of marraige. They had a terrible divorce and he lost alot of his retirement savings. He recently moved back to Texas(where his ex-wife lives) and he bought a town house with her. He put down $35,000 dollars but for some crazy reason the mortgage is in her name only. Now he feels she lied to him(again) and does not want to be faithful to him. He wants out but is afraid he will lose his $35,000 dollars. Is there anything that can be done to help him. I can't believe he did this to himself. THank you so much for any assistance you can offer.
