Brother won't take my name off

I cosigned for a house 3 years ago. I have never lived there and my brother has made all of the payments. I know he can take my name off by refinancing, but for some reason he won't. I have filed a Quit Claim Deed, but want my name completely off. It is effecting my credit and I can't get a house of my own. I have been told the only way to get my name off is to sue my brother. Is this true? Can anyone help? How can I get my name off?

The problem is not that your name is on the house, but that you cosigned for the loan. The lender has to agree to release you from obligation under the loan. Your borther cannot do this, the lender has to agree. Larry Maun 713.266.2560
