Builder delay in construction of our new home

My husband and I are having a new home built in arlington texas. We signed a contract in may and it is now close to november. We sold our existing home in order to have the new one built. the contract gave us an estimated finish month of november. We have been told that the builder is behind and as of today we dont even have a foundation poured. what are our legal rights as a consumer that is being inconvienced and also what is the responsibilitiy of the builder in this matter. Can we take any legal action?

I would have to review your contract to see if the home builder left an 'out' in the contract. Typically, the builders will make an allowance in the contract for a weather related delay. If they are significantly behind (and it sounds like they are) then you may be able to negotiate some compensation based on their lack of performance.
