Legal Question in Real Estate Law in Texas

We have a business and we did some work for some people that never paid us. We filed a lien on their house/property since it was worked done on their property (lot clearing, etc). Now the house is in forclosure. Will the mortage company have to settle the lien before they can resell the house?

Probably not. The liens would be subordinate (after) the mortgage lien. This means that they would be wiped out by the foreclosure. However, the obligation to pay isn't removed, only the security. You may have some other options, as well.
