Legal Question in Real Estate Law in Texas

the buyer wants to back out after we have been paid for the property... he declined to get a survey, and now the deed show it is smaller than the Realtor described it in the listing, he is barking fraud... the closing papers has the correct property details... he signed the papers btw and the title company disbursed funds already.... in my opinion he should have gotten a survey and is out of luck....the property was listed as an acre, as it was on the tax records, but there is an exception on the deed that divides the other half to someone else

You should have a lawyer look at all of your documents. He had a chance to back out when he got his commitment for title insurance. It is probably too late for him, but it will depend on the contents of all of the documents, including the contract.
